The Own Bank OwnBanker Service Terms and Conditions is provided to you by OWN BANK THE RURAL BANK OF CAVITE CITY, INC

hereinafter referred to as "OWN BANK") at the registered address: 505 P. Burgos Ave, Caridad, Cavite City, 4100 Cavite.

The Own Bank OwnBanker Service Terms and Conditions Agreement (hereinafter also referred to as "this Agreement") is concluded by you (hereinafter referred to as "Member" or "Own All Member") and Own Bank and has the same legal effect on both parties. Bank recommends that you carefully read the entire contents of this Agreement, especially the terms displayed in bold form that are (possibly) materially related to your rights and interests (including the relevant provisions of the Own Bank liability, your rights, dispute resolution methods and jurisdiction). If you believe that the bolded terms in this Agreement may cause damage to some or all of your rights or interests, please be sure to read them carefully again and continue to use the Own Bank OwnBanker Service Terms and Conditions on the premise that you have understood and accepted the bold terms.

Before a customer applies to us for the activation of Own Bank OwnBanker Service Terms and Conditions or uses the Own Bank OwnBanker Service Terms and Conditions for the first time, the customer shall carefully read the Terms and fully understand relevant provisions hereof. By applying to us for the activation of the Own Bank OwnBanker Service Terms and Conditions or using the Own Bank OwnBanker Service Terms and Conditions for the first time, customers shall be deemed to have carefully read, understood and accepted the terms and agreed to bound hereby.

If you do not agree to any or all of the terms of this Agreement, please do not proceed further or use the Own Bank OwnBanker Service Terms and Conditions in the form of confirmation (including, but not limited to, payment behavior/acceptance of gifts, or completion of all procedures for becoming a member without raising any objection to this Agreement with Own Bank during the process). When you proceed to the next step or use the Own Bank OwnBanker Service Terms and Conditions in the form of confirmation, it means that you have entered into an agreement with Own Bank, and you voluntarily accept this agreement and comply with all the provisions under this agreement.

Own Bank has the right to change the content of this agreement, once the content of this agreement changes, Own Bank will notify the corresponding page, website letter or other reasonable way, please read carefully. If you do not agree to the changed content, you may choose to stop using the OwnBanker Service Terms and Conditions. If you continue to use the OwnBanker Service Terms and Conditions, you will be deemed to have agreed to the entire content of the change. The updated Agreement shall be effective as of the date of the initial update.

1. Service Description

1.1. [Own Bank Own All Member]

means a natural person who has completed all the procedures for becoming a

member and, subject to compliance with this Agreement, enjoys the OwnBanker Service Terms and Conditionss provided by Own Bank during the membership period.

1.2. [Own Bank Own All Member Service]

is an exclusive membership benefit provided to you by Own Bank, please refer to the description of the rights and interests, please refer to Section 4 of this Agreement, and the rights and interests not specified in this Agreement are owned by Own Bank. The description on the platform member rights and interest’s introduction page shall prevail.

1.3. [Own Bank OwnBanker Service Terms and Conditions Agreement]

is a supplement to the Own Bank Service Agreement and the Own Bank Privacy Policy, is an integral part of it and has the same legal effect as it; In the event of a conflict between this Agreement and the foregoing Agreement, this Agreement shall prevail.

1.4. [Own Bank OwnBanker Service Terms and Conditions Rules]

is the agreement, announcement, page description, notice, FAQ and other content related to the OwnBanker Service Terms and Conditions that Own Bank has issued or will publish from time to time in the future.

2. Use of services

2.1. Service Acquisition

2.1.1. The Own Bank OwnBanker Service Terms and Conditions is a fee-based service, which you can purchase by paying the corresponding service fee;

2.1.2. When you obtain The Own All member services of Own Bank, you shall comply with laws and regulations, this Agreement, and shall not infringe the legitimate rights and interests of third parties or Own Bank.

2.2. Basic principles of service use

2.2.1. In the process of using The Own Bank All member service, you shall comply with laws and regulations and other normative documents, shall abide by public order, respect social morality, and shall not endanger network security;

2.2.2. Unless otherwise agreed by the parties, Own Bank grants you a personal, non-exclusive, non-commercial, revocable, termal license to use the Own Bank OwnBanker Service Terms and Conditionss. es. the OwnBanker Service Terms and Conditionss for your personal, non-commercial purposes.

3. Your Account Number

3.1. Account acquisition

During the validity period of your OwnBanker Service Terms and Conditions, your Own Bank Account with the benefits of Your Own Bank Membership Is your Own Bank All Member Account (i.e., the Own Bank Account bound to your OwnBanker Service Terms and Conditions, hereinafter referred to as "" Own All Account" or "Member Account").

Bank recommends that you review the Own Bank Service Agreement and related sub-agreements, various announcements, page descriptions and specification processes, FAQs, etc. to obtain more information about the rules for account usage.

3.2. Sign in

The Own Bank OwnBanker Service Terms and Conditions requires you to log in to your Own Bank Own All membership account.

3.3. Account management and security

3.3.1. You shall be solely responsible for and properly keep, use and maintain your Own All member account and password, and take necessary and effective confidentiality measures for your account number and password.

3.3.2. If you find that someone has used your account without authorization or your account has other abnormal circumstances that make it impossible to log in normally, you need to follow the account retrieval process officially announced by Own Bank to retrieve your account. During the recovery process, Own Bank may ask you to provide the appropriate information and/or supporting information, please ensure that the content you provide is true and valid, otherwise it may not be able to pass the verification of Own Bank and the recovery will fail.

3.3.3. In order to protect the security of the account and prevent the occurrence of account theft, Own Bank may from time to time or periodically use one or more ways to authenticate the user of the account (such as SMS verification, email authentication, etc.), if it does not successfully pass the verification, Own Bank has reasonable grounds to suspect that the account is stolen and other insecure situations. And, depending on the seriousness of the circumstances, decide whether to suspend the continued provision of member services to the account and/or take further measures.

3.3.4. Please note that your actions under your Own All Member Account are considered your own actions and you are responsible for the activities that occur under or through your Own All Account.

3.4. Information Inquiry

You can check your account information details for free by logging on to the relevant page of Own Bank Own All, including the content of the opened OwnBanker Service Terms and Conditions, service period, consumption record, etc.

3.5. Account independence

You understand and agree that your Own All account may only be used by you for non-commercial purposes. In addition to the membership time transfer service provided by The Own Bank official, you may not transfer, donate, sell, rent, or share the member account and/or rights to a third party, otherwise you shall bear the loss of the account due to the above behavior, such as loss, leakage, tampering, theft, etc., or the account abnormality caused by the security risk control triggered by multi-terminal login, off-site login, etc., or even the loss of the account being blocked.

4. Related to the rights and interests of members

4.1. Own All membership benefits

Own Bank Own All membership benefits, including cash in, transfer, cash out, send cash and other fee reduction privileges, fee reduction details subject to the Own Bank actual page display instructions.

Own Bank may make certain adjustments to the rights and interests of members in accordance with changes in laws, regulations and policies, its own operating strategies, etc., including but not limited to changes in fee reductions, new or reduced related service privileges, and the types of member rights, the specific content of the rights and interests and the rules of use are subject to the membership agreement and/or the description on the page of the corresponding product.

4.2. Own Bank hereby reminds you in good faith that the service content has a certain validity period after you have successfully paid (the specific instructions on the purchase page shall prevail), please remember to use it in time.

4.3. Preferential policies

Own Bank may give extensions, rights upgrades, etc. to the Own All member services that have been purchased at different stages and are continuously valid according to the actual operation situation, and the specific preferential policies are subject to the content notified by Own Bank on the relevant service page.

4.4. Usage Specifications

When you obtain and use the Own Bank OwnBanker Service Terms and Conditions, you should follow the procedures and platform specifications published by the official channels of Own Bank:

4.4.1. Do not illegally obtain The Own Bank OwnBanker Service Terms and Conditionss (including but not limited to some or all of the Own All rights and interests, Own All member accounts) through channels, methods or channels not authorized or published by Own Bank;

4.4.2. You may not participate in the Event or receive benefits through improper means or in a manner that violates the principle of good faith (such as exploiting rule vulnerabilities, exploiting system vulnerabilities, abusing membership, black industry, speculation, etc.) contrary to the original intention of OwanBank to provide services/organize the Event.

If you violate the above agreement, Own Bank has the right to delete, cancel, clear and other processing of the rights and interests you have obtained, and has the right to terminate the provision of services to you, and all losses caused thereby shall be borne by yourself.

4.5. Duration of Service

4.5.1. The service period of your OwnBanker Service Terms and Conditions is subject to the service period corresponding to your own selection and payment of the corresponding membership fee, from the time you become an Own All Member, you can log in to the relevant page of Own All Membership of The Own Bank for free. This period is not extended by reason of your non-use. When the membership service period expires, Own Bank will stop providing you with the OwnBanker Service Terms and Conditions; However, if you activate the automatic renewal service and you successfully renew the subscription before the expiration of the service period, the member service period will be extended on the basis of the original service period. OwnBanker Service Terms and Conditions can unilaterally stop the automatic renewal service before the expiration of the service validity period in the current period, and Own Bank may unilaterally stop the automatic renewal service to you according to the needs of the operation policy, and the OwnBanker Service Terms and Conditions period shall terminate from the date of expiration of the current service period.

4.5.2. Please understand that due to the particularity of the Internet service, the Terms of Own All Membership Includes the reasonable time required for The Handling of Faults, Server Repairs, Adjustments, Upgrades, etc. by Own Bank or for third party infringement Own Bank will minimize the impact as much as possible.

5. Charges and cancellations

5.1. Charging method

The Own Bank OwnBanker Service Terms and Conditions is a fee-based service, and you can pay the Own All membership fee through the payment methods actually supported by Own Bank.

5.2. Refund of fees

OwnBanker Service Terms and Conditionss are network goods and virtual goods, membership fees are the corresponding online goods price of the membership services you purchase, not prepayments or deposits, deposits, savings cards, etc.

OwnBanker Service Terms and Conditionss are non-refundable once they are opened (such as you are completely unable to use the OwnBanker Service Terms and Conditionss due to major defects) except in cases there is a (i) breach of contract as otherwise agreed in this Agreement, (ii) if a refund is required by laws and regulations, or (iii) if Own Bank agrees to a refund, etc.

Own Bank hereby reminds you that you should carefully check your account information, purchased service content, price, service period and other information before purchasing The OwnBanker Service Terms and Conditions (including the automatic renewal service).

5.3. Changes in charging standards and methods

The charging standards for OwnBanker Service Terms and Conditionss (including automatic renewal) are independently decided by Own Bank based on the company's operating costs, operating strategies, etc. (adjustments include but are not limited to promotions, price increases, etc.), as shown on the relevant product and service promotion and payment page; If the relevant charging method changes when you purchase and renew, the charging method actually supported by Own Bank shall prevail; If the price of the relevant service is adjusted, the current effective price published on the Own Bank platform shall prevail, unless otherwise agreed between The Own Bank and you.

5.4. Auto-renewal

The automatic renewal service refers to the service launched under the premise that the member has purchased the OwnBanker Service Terms and Conditions, out of the member's demand for automatic renewal, to avoid the member's negligence or other reasons leading to the failure to renew the fee in time. If the Member chooses to activate the auto-renewal service, the Member authorizes Own Bank to entrust Own Bank to withhold the fees for the next billing cycle 24 hours before and after the expiration of the Member's auto-renewal period. This service is implemented on the premise that you have activated auto-renewal and can successfully debit the full amount from the above accounts.

5.4.1. Billing Period: Annual.

5.4.2. Automatic deduction rules:

5.4.2.1. If auto-renewal is selected, the user agrees that the payment channel may deduct the membership service fee for the next billing cycle from the user's bound account without verifying the member account password, payment password, SMS verification code and other information.

5.4.2.2. Unless the member or Own Bank voluntarily and explicitly cancels the automatic renewal, the automatic deduction is valid for a long time and is not limited to the number of times.

5.4.2.3. If you do not voluntarily and explicitly cancel the automatic renewal,

it will be deemed that you agree that Own Bank may make deduction attempts from time to time within a certain period of time after the expiration of the membership service period in accordance with the payment channel's debit rules (even if the amount in your account is insufficient).

5.4.2.4. Once the deduction is successful, Own Bank will open the OwnBanker Service Terms and Conditions corresponding to this billing cycle for you.

5.4.3. Cancellation method:

Own Bank APP--> "profile" page -- > "Settings" - > "Own All Auto-Renew"

Turn off auto-renewal;

You acknowledge and agree that there may be a delay in the display of auto-renewal status updates, subject to your renewal status displayed in the Own Bank APP. sted to Own Bank to automatically renew is still valid, and Own Bank will not refund and compensate the fees deducted based on the instruction before the cancellation operation is completed.

6. Your Code of Conduct and Handling of Breach of Contract

6.1. In the process of using the Own Bank OwnBanker Service Terms and Conditions, the following shall be prohibited and shall constitute Breach of Contract:

6.1.1. Without the express authorization of Own Bank, modify the service content, service period, transaction status and other information through technical means;

6.1.2. Provide the Own All Member Services to others through means not expressly authorized by Own Bank (including but not limited to borrowing, renting, selling, sharing, transferring);

6.1.3. hack, alter, reverse operate, tamper with or otherwise disrupt any security measures technology used by Own Bank to protect the Own All Member Services;

6.1.4. Other acts that are not expressly authorized by Own Bank or violate this Agreement, laws and regulations or regulatory policies, and infringe the legitimate rights and interests of third parties or Own Bank.

6.2. You acknowledge and agree that if you have any behavior that violates pertinent laws, regulations or regulatory policies, violates this Agreement, or damages the reputation and interests of Own Bank or/or its affiliates Own Bank reserves the right to take one or more of the following actions:

6.2.1. If this Agreement has a separate clause on the handling of this act, it shall be handled in accordance with that clause;

6.2.2. Take one or more measures to stop your actions and the consequences of your actions, such as deleting/blocking relevant links or content, restricting/canceling your account/account use rights, etc.;

6.2.3. Interrupt or terminate part or all of the Own All Member Services, and the Fees you have paid for the Own All Member Services will not be refunded and will not be compensated in any form;

6.2.4. If your actions cause Own Bank or/or its affiliates to suffer any losses, you shall be liable for all losses at Own Bank Completion of fee payment within the required time limit

7. Interruption and Termination of Services

7.1. Interruption or termination of the Service includes the following circumstances:

7.1.1. You make a request;

7.1.2. You have any behavior that violates national laws, regulations or regulatory policies, violates this Agreement, or damages the reputation and interests of Own Bank or/or its affiliates;

7.1.3. Own Bank in accordance with the provisions of laws, regulations, regulatory policies or the requirements of competent authorities;

7.1.4. Own Bank is necessary for emergency situations such as maintaining account and system security;

7.1.5. Force majeure (force majeure refers to: unforeseeable, unavoidable and unavoidable objective circumstances, including national laws, regulations, policies and orders of state organs and other government actions or other such as typhoons, floods, earthquakes, tsunamis, wars, strikes, etc.);

7.1.6. Other circumstances that Own Bank cannot resist.

7.2. In the event of the aforesaid termination, Own Bank will handle the interruption or termination of the Service with you in accordance with the provisions of laws and regulations.

8. Protection of Your Personal Information

Own Bank understands the importance of personal information to you, so Own Bank attaches great importance to the protection of your personal information and treats your personal information with a high degree of care and obligation. In the course of your use of the Own Bank OwnBanker Service Terms and Conditionss, Own Bank will employ relevant technical measures and other security measures to protect your personal information.

9. Notices

In order to facilitate you to obtain information related to this Agreement and the Own All Member Service, you agree that Own Bank has the right to notify you through one or more methods such as web page publicity, page prompts, pop-up windows, message notifications, website letters, and your reserved contact information (such as mobile phone SMS, email, etc.), which shall be deemed to have been successfully delivered to you from the time of sending by Own Bank. If multiple notification methods coexist, the time of delivery shall be subject to the earliest sending time of the above methods.

The content of such notices may have a significant advantage or adverse effect on you, please be sure to ensure that the contact information is valid and please pay attention to the corresponding notice in a timely manner.

10. Contact Own Bank

If you have any questions about this Agreement or the use of the Own All member service (including problem inquiries, complaints, etc.), Own Bank has provided you with a variety of feedback channels, hoping to provide you with satisfactory solutions:

10.1. Online customer service / other online feedback channel: you can contact the online customer service on the product function page on the Own Bank platform or submit feedback online;

10.2. Manual customer service channel: You can call any customer service number of Own Bank to contact Own Bank;

10.3. Special email channel: Own Bank has set up a cs@ownbank.com.ph mailbox, you can contact Own Bank through this mailbox;

10.4. Other ways: Other feedback channels provided by Own Bank. We will get back to you as soon as we receive your feedback.

11. Miscellaneous

11.1. Use of the Own All member service account, and these Terms and Conditions shall be governed by and construed in accordance with Philippine Law and you hereby submit to the exclusive jurisdiction of the courts of Cavite City.

11.2. If any dispute or claim arises from or in connection with these Terms and Conditions or your use of your Own All member service account (“Dispute”), the relevant parties shall first attempt to resolve the Dispute through amicable negotiations. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in class, consolidated or representative action.

In any event and to the fullest extent permitted by applicable law, you may not make any claim against the Indemnities under these Terms and Conditions after one year from the date of occurrence of the matter giving rise to the claim.

11.3. If at any time any provision of these Terms and Conditions become illegal, invalid or unenforceable in any respect, the legality, validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected or impaired thereby, and shall continue in force as if such illegal, invalid or unenforceable provision was severed from these Terms and Conditions.

11.4. The title of this Agreement is for convenience and reading only and does not affect the meaning or interpretation of any provision in the body.

11.5. Unless otherwise provided under these Terms and Conditions, the provisions of these Terms and Conditions and our rights and remedies under these Terms and Conditions are cumulative and are without prejudice and in addition to any rights or remedies we may have in law or in equity, and no exercise by us of any one right or remedy under these Terms and Conditions, or at law or in equity, shall (save to the extent, if any, provided expressly in these Terms and Conditions or at law or in equity) operate so as to hinder or prevent our exercise of any other such right or remedy at law or in equity.

11.6. Our failure to enforce these Terms and Conditions shall not constitute a waiver of these terms, and such failure shall not affect our right to later enforce these Terms and Conditions.

11.7. A person or entity who is not a party to these Terms and Conditions shall have no right to enforce any term of these Terms and Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this clause shall affect the right of any permitted assignee or transferee of these Terms and Conditions.

11.8. We may seek immediate injunctive relief if we make a good faith determination that a breach or non-performance is such that a temporary restraining order or other immediate injunctive relief is an appropriate or adequate remedy.

11.9. Any typographical, clerical error or omission in any acceptance or other document on our part shall be subject to correction without any liability on our part.

11.10. These Terms and Conditions shall constitute the entire agreement between you and us relating to the subject matter hereof and supersedes and replaces in full all prior understandings, communications and agreements with respect to the subject matter hereof.

11.11. You acknowledge and agree that any records (including records of any telephone conversations relating to the Own All member service account, if any) maintained by us and/or our service providers relating to or in connection with the Own All member service account shall be binding and conclusive on you for all purposes whatsoever and shall be conclusive evidence of any information and/or data transmitted between us and you. You hereby agree that all such records are admissible in evidence and that you shall not challenge or dispute the admissibility, reliability, accuracy or the authenticity of such records merely on the basis that such records are in electronic form or are the output of a computer system, and you hereby waive any of your rights, if any, to so object.

11.12. Own Bank reserve the right to delegate or sub-contract the performance of any of our functions or obligations in connection with Own All member service account to any service provider, subcontractor and/or agent on such terms as we may deem appropriate.

11.13. You may not assign your rights or transfer your obligations under these Terms and Conditions without our prior written consent. We may assign our rights or transfer our obligations under these Terms and Conditions to any third party at our sole discretion.

11.14. Own Bank shall not be liable for non-performance, error, interruption or delay in the performance of our obligations under these Terms and Conditions (or any part thereof) of for any inaccuracy, unreliability or unsuitability of Own All member service account if this is due, in whole part, directly or indirectly to an event or failure which is beyond our reasonable control.
